License

Unless stated otherwise, Postier owns the intellectual property rights for all material associated with the Postier platform, including but not limited to the software, website design, and proprietary features.

You retain all ownership rights to your original content, including text, images, and media that you upload to the platform. Any content you create using Postier's AI-powered tools becomes your property, and you are free to use it across your social media platforms.

You must not:

• Reproduce, duplicate or copy the Postier platform software, code, or proprietary features
• Reverse engineer, decompile, or attempt to extract the source code of the Postier platform
• Use the platform to create content that violates applicable laws or third-party rights
• Resell, redistribute, or provide access to the Postier platform to third parties without authorization

Postier reserves the right to monitor content generated through the platform and remove any content that is considered inappropriate, offensive, spam, or violates these Terms and Conditions of Use.

You warrant and represent that:

• You have all necessary rights, licenses, and permissions to upload and publish content through the platform;
• Your content does not infringe any intellectual property rights, including copyright, patent, or trademark of any third party;
• Your content does not contain defamatory, libelous, offensive, indecent, or otherwise unlawful material;
• You will comply with all applicable social media platform terms of service when publishing content through Postier;
• You will not use the platform to engage in spam, fraudulent activities, or any form of abuse.

You grant Postier a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the service. This includes generating AI-powered suggestions, scheduling posts, and analytics. We will not use your content for any other purpose without your explicit consent.

Hyperlinking to our Content

Organizations may link to our website without prior written approval. These organizations may link to our home page, documentation, blog posts, or other publicly available information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.

iFrames

Without prior approval and written permission, you may not create frames around our web pages that alter in any way the visual presentation or appearance of our website.

Acceptable Use Policy

You agree to use Postier in compliance with all applicable laws and regulations, as well as the terms of service of all connected social media platforms including but not limited to LinkedIn, Instagram, TikTok, X/Twitter, YouTube, Pinterest, Reddit, Threads, Mastodon, Bluesky, Facebook, and Google Business Profile.

You agree NOT to use Postier to:

• Create, publish, or schedule spam, unsolicited messages, or any form of automated abuse across social media platforms
• Violate any third-party social media platform's terms of service, rate limits, or usage policies
• Engage in any activity that could harm, disable, or impair the platform or interfere with other users' access to the service
• Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to other users' accounts or data
• Use the platform for any commercial purpose not expressly permitted by your subscription plan

Postier reserves the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated this Acceptable Use Policy or engaged in any activity that could damage our reputation or violate third-party platform policies.

You acknowledge that Postier integrates with third-party social media platforms and that changes to these platforms' APIs, policies, or terms of service may affect the availability or functionality of certain features. We are not responsible for any disruptions caused by third-party platform changes.

Disclosure of personal information to third parties

We may disclose personal information to:

• third party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, hosting and server providers, ad networks, analytics, error loggers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators;
• credit reporting agencies, courts, tribunals and regulatory authorities, in the event you fail to pay for goods or services we have provided to you; and
• third parties to collect and process data.

Some of your personal data and content is shared with third party service providers such as:

• AI Service Providers : We use third-party AI providers (such as OpenAI, Anthropic, Google Gemini, and others) to power our AI content generation features. When you use AI-powered features, your prompts and content may be processed by these providers. We do not share personal identifying information with AI providers beyond what is necessary to generate content.

• Social Media Platforms : When you connect your social media accounts, we access and process data from these platforms (LinkedIn, Instagram, TikTok, X/Twitter, YouTube, Pinterest, Reddit, Threads, Mastodon, Bluesky, Facebook, Google Business Profile, etc.) to provide scheduling, publishing, and analytics services. Your data is processed in accordance with each platform's privacy policy and API terms.

• Google : We rely on Google Analytics to gather analytics and usage data about our website to improve our services.

• Stripe : We use Stripe to process all payments. Information such as credit card information, name, address and email are processed and stored by Stripe. We do not have access to your credit card details at any point in time.

• ScaleWay : We use ScaleWay to host most of our servers and databases. The information stored is necessary to provide our service.

• Sentry : Sentry is used to track potential bugs in our system. Your name and email may appear in their system for debugging purposes.

• Mailgun : We rely on Mailgun to send all our transactional emails. Information like your name and email may be processed by Mailgun.

Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the service or on any related website is inaccurate at any time without prior notice.

We undertake no obligation to update, amend or clarify information in the service or on any related website, including without limitation, pricing information, except as required by law.

Optional tools and services

We may provide you with access to third-party tools and services over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party providers.

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

Payment

Paid plans

When you sign up for a paid plan, you must select one of the available packages: "Starter", "Pro", "Agency", or "Enterprise". Each package offers different pricing, features, limitations, and AI generation credits.

All paid plans include a monthly allocation of AI generations for creating social media content. Once you exceed your monthly AI generation limit, you may purchase additional AI generation packs or upgrade to a higher tier plan.

You will always have the option to upgrade to a higher plan at any time. The upgrade will take effect immediately, and you will be charged the prorated difference for the remainder of your current billing cycle.

You will also have the option to downgrade to a lower plan at any time, but if you elect to downgrade during a billing cycle, your downgrade will not be effective until the end of that billing cycle, and you will still be charged for that entire billing cycle at the higher tier (including any applicable additional charges for the higher tier).

When you sign up for a monthly plan, you agree to monthly recurring billing, starting on the date you sign up. Billing occurs on the same day each month, based on the date that you started your plan. Payments are due for any month on the same or closest date to the day you made your first monthly payment.

If any part of a month is included in the billing term, then payment is required for the full month. You may pause or cancel your subscription at any time, though you will not receive a refund for the current billing period. Upon cancellation, you will retain access to paid features until the end of your current billing cycle.

When you sign up for a yearly plan, you agree to yearly recurring billing, starting on the date you sign up. Yearly plans offer a discounted rate compared to monthly billing. The same terms apply to yearly plans as to monthly plans.

Free plan

The free plan allows you to use Postier with limited features, including a restricted number of social accounts, posts per month, and AI generations. If you exceed the free plan limits or require additional features, you will be required to upgrade to a paid plan.

AI Generations and Credits

Each plan includes a specific monthly allocation of AI generations for creating posts, captions, threads, and other AI-powered content. AI generation limits reset monthly on your billing renewal date.

If you exceed your monthly AI generation limit, you may purchase additional AI generation packs as add-ons. Unused AI generations do not roll over to the next billing period.

Debit and Credit Cards

As long as you’re a user with a monthly or yearly plan or otherwise have an outstanding balance with us, you’ll provide us with valid debit or credit card information and authorize us to deduct your charges against that card.

You’ll replace the information for any card that expires with information for a valid one. If your card is automatically replaced with a new card by a payment processor, you acknowledge and agree that we’re authorized to deduct any charges on your account against the new card.

Anyone using a card represents and warrants that they are authorized to use that card, and that any and all charges may be billed to that card and won’t be rejected. If we’re unable to process your card order, we’ll try to contact you by email and may suspend your account until your payment can be processed.

Refunds

We’ll give you a refund for a prepaid month if we stop providing the service and terminate your account without cause. You won’t be entitled to a refund or credit from us under any other circumstances. We may, at our sole discretion, offer a refund, discount or credit.

Pricing changes

We may change our fees, including our charges for monthly and yearly plans, both for startup and business, at any time by posting a new pricing structure to our website or in your account and/or sending you a notification by email.

Modifications

Postier may revise these Terms of Service for its website at any time without notice. By using this service and it's website you are agreeing to be bound by the then current version of these Terms of Service.

Account Termination and Data Retention

You may terminate your account at any time through your account settings. Upon termination, your access to paid features will continue until the end of your current billing period, after which your subscription will not renew.

We reserve the right to suspend or terminate your account at any time if:

• You breach these Terms of Service
• You violate our Acceptable Use Policy
• Your account remains inactive for an extended period
• Payment for your subscription fails and remains unpaid
• We are required to do so by law

Upon account termination, we will retain your data for a period of 30 days to allow for account recovery. After this period, your content, scheduled posts, and analytics data will be permanently deleted from our servers. Social media account connections will be immediately revoked.

You may request a copy of your data before terminating your account. We will provide your data in a standard exportable format within 30 days of your request.

Certain information may be retained longer if required by law or for legitimate business purposes, such as billing records, audit trails, and fraud prevention.
